Yes. Section 26 of the Strata Property Act states:
Subject to this Act, the regulations and the bylaws, the council must exercise the powers and perform the duties of the strata corporation, including the enforcement of bylaws and rules.
If a strata corporation determines that a bylaw or rule has been breached, it has three enforcement options. Section permits a strata corporation to:
- Levy a fine against an owner or tenant;
- Take steps to fix or otherwise remedy the contravention; and
- Deny access to a recreational facility for a reasonable amount of time.
Although a strata corporation has a duty to enforce the bylaws and rules, it may choose to provide a person with a warning or give a person time to comply with the bylaws or rules before using one of the enforcement tools available to it.
