Section 72 of the Strata Property Act provides that, with the exception of limited common property designated for the exclusive use of one or more owners, the strata corporation is required to repair and maintain common property.
This section of the Act does states that a strata corporation may pass a bylaw making common property the responsibility of owners if permitted in the regulations, but no such permission is currently found in the regulation.
